These Terms & Conditions (“Terms”) govern your use of the SPARC South Florida website and your participation in the SPARC program, including any application, event, or competition associated with it. By accessing this website or submitting an application, you agree to be bound by these Terms.

 

1. Overview

SPARC South Florida (“SPARC,” “we,” “our,” or “us”) is a startup competition and accelerator program designed to support founders through mentorship, investor access, and competitive opportunities, including participation in the Startup World Cup.

 

2. Eligibility

By applying to SPARC, you confirm that:

– You are authorized to represent your company
– All information submitted is accurate and complete
– Your company complies with all applicable laws and regulations
– You are not infringing on any third-party intellectual property

SPARC reserves the right to disqualify any applicant at its sole discretion.

 

3. Application Process

– Applications must be submitted through the official SPARC website
– Only one application per company is permitted
– Applicants are responsible for ensuring all materials are submitted correctly
– Submission does not guarantee acceptance into the program

SPARC may request additional information or documentation during the review process.

 

4. Selection & Participation

– Selected applicants may be invited to participate in program activities, events, and pitch competitions
– Participation requirements, timelines, and expectations will be communicated separately
– SPARC reserves the right to modify program structure, timelines, or components at any time

Failure to comply with program requirements may result in removal.

 

5. Intellectual Property

You retain ownership of your intellectual property. However, by submitting materials to SPARC, you grant SPARC a non-exclusive, worldwide, royalty-free license to:

– Review and evaluate your application materials
– Share materials with judges, mentors, partners, and sponsors
– Use your company name, logo, and non-confidential information for promotional purposes

SPARC will not knowingly disclose confidential information without your consent, except as required for evaluation.

 

6. Media Release

By participating in SPARC, you agree that:

– Your participation, company name, and related content may be used for marketing and promotional purposes
– Photos, videos, and event recordings may include your likeness and be distributed across digital and media platforms
– SPARC may publicly announce selected participants and winners

 

7. No Guarantee of Funding

Participation in SPARC does not guarantee:

– Investment or funding
– Selection for the Startup World Cup or any global competition
– Business outcomes, partnerships, or financial success

Any references to funding opportunities (including $1,000,000 competitions or direct investment) are subject to separate terms and conditions from those programs.

 

8. Code of Conduct

Participants are expected to:

– Act professionally and respectfully
– Provide truthful and accurate information
– Engage in fair competition

SPARC reserves the right to remove any participant for misconduct, misrepresentation, or behavior that may harm the integrity of the program.

 

9. Limitation of Liability

To the fullest extent permitted by law:

– SPARC is not liable for any direct, indirect, incidental, or consequential damages arising from participation
– SPARC makes no guarantees regarding outcomes, funding, or business success
– Participation is at your own risk

 

10. Third-Party Relationships

SPARC may collaborate with sponsors, partners, and third-party organizations. We are not responsible for:

– Actions, services, or decisions made by third parties
– Any agreements entered into between participants and third parties

 

11. Privacy

Your use of this website and submission of information is also governed by our Privacy Policy. By applying, you consent to the collection and use of your data as outlined therein.

 

12. Modifications

SPARC reserves the right to update or modify these Terms at any time. Continued use of the website or participation in the program constitutes acceptance of any updates.

 

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
